Mindvate (Pty) Ltd, herein referred to as “Mail Blaze,” recognizes the importance of protecting intellectual property (IP) rights and adheres strictly to IP laws. This document aims to outline our policies and guidelines concerning the use and protection of intellectual property on our email marketing platform.

1. Content Ownership

1.1. All content uploaded, sent, or otherwise made available via Mail Blaze, including text, images, videos, data, and other material, remains the exclusive property of the account holder, or its rightful owner, and is protected under international copyright laws.

1.2. Users are responsible for securing all necessary permissions and ensuring that content utilized in their campaigns does not infringe upon the IP rights of third parties.

2. Prohibited Uses

2.1. Users shall not infringe upon the intellectual property rights of others. Prohibited uses include, but are not limited to, unauthorized use of copyrighted materials, trademark infringement, and patent violation.

2.2. Selling or distributing unauthorized reproductions of work, such as software, recordings, photographs, books, or other copyrighted works, is strictly prohibited.

3. Trademarks

3.1. All logos, names, and trademarks used on the Mail Blaze platform are the property of their respective owners.

3.2. Users must refrain from using any trademarks, service marks, or trade names of Mail Blaze or third parties unless explicitly authorized.

4. Copyright Infringement and DMCA Policy

4.1. Mail Blaze respects the intellectual property rights of others and expects its users to do the same. We respond to clear notices of alleged copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

4.2. Notifications of claimed copyright infringement should be sent to our designated agent via our Contact Us page. To be effective, the notification must be in writing and contain the following information (DMCA, 17 U.S.C. §512(c)(3)):

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the right being infringed;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material claimed to be infringing in a sufficiently precise manner to allow us to locate the material;
  • Adequate information by which we can contact the complainant;
  • A statement that the complainant has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complainant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. Remedies and Violations

5.1. Upon notification of alleged infringement, Mail Blaze will take appropriate action, which may include removing or disabling access to the content claimed to be infringing and/or terminating the user's account.

5.2. Mail Blaze reserves the right to suspend, deactivate, or delete the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights, or other intellectual property rights, of others.

6. Modifications

6.1. Mail Blaze reserves the right to modify these Intellectual Property Guidelines at any time. Changes will be effective upon posting, and users are advised to check this page periodically.
